Biography

An AV-rated, seasoned attorney with significant experience in federal and state litigation and appeals, Tim George brings a particular emphasis on briefing, research, analysis and insurance coverage to PMM. A Harvard Law School cum laude graduate and a Southern Methodist University summa cum laude graduate, Tim has devoted his entire career to working on complex, sophisticated business matters for a variety of clients, including Fortune 500 corporations, insurance companies, small businesses, and individuals.

Tim has over 35 years of experience handling a broad range of matters, including assisting in complex litigation, preparing complex pre- and post- trial motions, insurance coverage analysis and opinions, insurance coverage litigation, and commercial business litigation. Tim has had primary responsibility for handling appeals and mandamus proceedings in Texas and elsewhere, in both state and federal courts.

Representative Cases

  • Insurance Coverage: Represented major insurance companies in insurance coverage matters, including issuing coverage opinions, prosecuting and defending declaratory judgment actions, and handling insurance-related appeals. Represented insureds in insurance coverage and indemnification matters, including enforcing indemnification agreements in the construction and oil and gas industries and prosecuting actions for additional insurance coverage from subcontractor carriers.
  • Litigation Support: Responsible for preparation and filing of pleadings, pre-trial motions and responses, jury charges, and post-trial motions and responses involving all aspects of trial court practice in support of clients involved in civil litigation.
  • Appellate: Responsible for research and briefing related to significant appellate matters, including reported cases from the Texas Supreme Court and Fifth Circuit Court of Appeals, such as:
    • JLB Builders, LLC v. Hernandez, 622 S.W.3d 860 (Texas Supreme Court, 2021) (upholding summary judgment granted in favor of construction company, and establishing standards applicable to general contractor liability for injuries to subcontractor employees).
    • Endeavor Energy Res., LP v. Cuevas, 593 S.W.3d 307 (Texas Supreme Court, 2019) (upholding summary judgment granted in favor of oil & gas company and establishing that statutory protections applicable to land owners and general contractors apply to negligent hiring claims).
    • Ovalee v. United Rentals N. Am., Inc., 2022 U.S. App. LEXIS 24854 (5th Circuit Court of Appeals, 2022) (upholding summary judgment granted on employee's premises liability claim).
    • OOIDA Risk Retention Group, Inc. v. Williams, 579 F.3d 469 (5th Circuit Court of Appeals, 2009) (reversing summary judgment granted against an insurer on its duty to defend and indemnify a trucking company's driver and establishing rules for applying employee exclusions in the context of interstate trucking).
